My sister is 23 and just got her 2nd DUI this last weekend in Sacramento County?

My sister is 23 and just got her 2nd DUI this last weekend in Sacramento County?
1st was when she was 19 and paid all fines etc. However, scared that she might go to jail. She has a job and is student, does that matter that she is employed and in school? She woke up in the hospital and doesn't know how she got there, last remembers passing out in backseat of her car. Should she get a lawyer? What should she expect?

Of course she needs a lawyer. That story about blacking out isn't going to help her much though. That only makes it look even worse. The fact that she's employed and in school is completely irrelevant. If she kills somebody with her recklessness and stupidity her student status won't bring them back to life.

They will take it into consideration yes. She can expect house arrest/ankle monitor, heavy fines, insurance premium hikes, loss of DL for up to a year, possibly some jail time w/possible work release, and at least a few weekends in jail. It could also mean real jail time if the judge sees reason to do so.

She got off very easy the first time, compared to many other states. I would be expecting some jail time for this one, followed up by a suspended license, probation and community service. She'll very possibly lose her job because of it. She is lucky to be alive. She is lucky she did not kill anyone.
