Could I sue our local Alabama public school?
Ok, I don't want anyone thinking I am sue happy or anything, but here goes. My children recently moved in with me from their fathers home. Actually this is August and they moved here in January. The reason that they moved here is that my children had some emotional problems and had even been put into alternative school in Florida where they moved here from. My daughter has since been diagnosed as bipolar. My son was just not happy there any longer. Their father decided that maybe it would be best that they came to live with me for the best interest of the children. I am a stay at home mom and can offer more one on one attention and be there more than he could at that time and also because maybe they would be happy here. He was seriously worried that one day he would wake up and one of them would be dead. So after an incident in January where my son was rushed to the hospital on a Friday he called and asked me to come get them an I did the very following day. It is approx. 7-8 hours to drive on way to get there so I couldn't go right then. Here is where my question comes in. The school here would not let me register them without my divorce papers being modified to say that the children would be living with me during the school months. The docket in Florida where they live is quite long. Even after getting a change of venue to a different county where he lives and the docket was shorter, we have still been waiting for our day in court over this. The school here in Alabama has refused to budge whatsoever. I have asked if I had a notorized letter from their father would that work to register them while waiting for the papers from the court, they said 'no.' I have asked if he came here to register them and let them know in person that they were going to be living with me could they be registeres. They again said no, because he was not a resident of the school district. I have asked several people and gotten help from many others in finding the right questions to ask officials, etc. I have even went to our local courthouse and asked what to do at the DA's office and a woman who used to work int he family court division, said that I should be able to get a letter from the court where the paper work was files that says that a modification has been filed and that should work to let the children get registered. I called to make sure that would work from the school before I followed through on this, and again the school said 'no.' I have called, and went to our city school board and they say that it is up to the principle of the school, who repeatedly has told me 'no.' I called the county school board and they told me it was up to my city school board. I cannot afford the cost of home schooling my children. They already failed school last year because they were unable to take their exams. Teh school they attended in Florida allowed them to do their school work online for the remainder of the year last year, but alas there was nowhere for them to go to take their exams, and so they failed. Not to mention that they were doing their work online and while they could do it, they still lacked classroom instruction which was necessary for them to fully understand what they were learning. I may have been able to understand what they were doing, but I am unqualified to properly teach that to my children as they need. I am no teacher as far as academically. I can help with homework, etc., but I cannot replace a good teacher. So my children had fallen behind as it was and I am not sure that if they had somewhere to take the exams last year whether they would have passed anyway. I checked on getting something from the courts locally so that I could get them registered, but the courts in Florida hold jurisdiction because that was where the original divorce and custody was filed. So I could not do it in the state of Alabama. I am at my whits end with this and my children need and deserve the right to catch up. It is their constitutional right to have an education, but what can a person do when a school will not budge to allow a child to get an education. I would like for children to be able to catch up with their prper grade. My daughter is 13 and will turn 14 and she is still in the 6th grade. My son is 14 and will 15 in the 7th grade. This is unacceptable when this could have been avoided, had they been given a chance. Now we have just started a new school year and my children cannot do school work online any longer and they are still unable to attend school, so by the time they are able to they will either have missed too many days to pass or be so far behind this school year to be able to catch up. Home schooling is too expensive for me and therefore is not an option. Can I sue the school for this in order to afford tutors to help my children with their education and possibly be able to have them catch up. Also to help change the school rules on this. I understand the reason to have them, but when I have exhausted every means of enrolling them including their father registering them, what can I do? I did get a local judge today to say that the treatment is unfair and granted me a custody order so that I could enroll them. I had already gone to the DA's office to get some help and ask a couple questions as I said and they had even told me that I should be able to take a paper there from the court where the modification was filed and should be able to enroll them. The school, as I have heard likes to keep anyone who might cause a stir and be somewhat difficult out of their school. Also when I first posted this question, it was before I had gotten the phone call from sayong that the judge would see and help me. I will not delete this question as it may help someone else and I think some people need to be more considerate. I asked for help, not to be critisized. Thanks to all those that did help me and good luck to all those that may be in similar circumstances and don't give up. I HAVE been very persistant. I had lawyers, juvenile probation officers and the DA's office even helping me because I wouldn't give up. Education is important and American Children's right as an American citizen to have it.

From what you said, I assume their father has legal custody. If so, then there really is not anything you can do with the school until this is changed. About the only thing you can do is try to get the courts in Florida to expedite your case because of the situation with the school.

Wow Missy! Is it possible that the person is remarried and has other children? Anyway, I think there are special rules that help public schools from being sued, but I'm not positive.

You can sue anybody for anything, however I would do just what the people told you to. Get the modification and a notarized letter from the Dad and take the documents there in person, to both the school board and the local school. If that school still says no, then ask for a zoning exemption and put them in another school. If you do have to take it to court you have the documents and proof that you did do what they told you to back you up. If push comes to shove and the Dad is ok, then just have him come to your state and register them, all he has to really do is have junk mail sent to your house. You have to stop being lazy and fight, this is a fight you should have been in their face everyday if necessary 8 months ago. Good luck

You should have put your focus on getting an emergency order done in the state of Florida, that way your children could have gotten in school back in January. It is surprising that you have not been able to get this matter thru the court system in the last 8 months? Your ex-husband should have contacted an attorney to handle the matter in the most efficient matter possible. Your ex-husband should have coordinated with you to pick up the children to bring them to a testing site in Florida for them to take their final exams. His lack of effort on his part can be attributing to the delay in the process. The Alabama school system is doing nothing wrong, according to the documents you have you do not have the authority to register the children in school or have them living with you. Like they said, you must get the modification from Florida. It seems as if your ex-husband was overwhelmed by your children and the issues they have, especially if they were already in the alternative school system in Florida. I hope you have addressed their unique issues with the Alabama school system so they can get the appropriate resources. It seems as if your children are at least a couple of years older than their peers, this fact alone will make them sick out among the crowd, but if they have emotional/behavioral difficulties, the school system will need to know because the children will soon pick up on it and their transition to the schools in Alabama will be difficult.

You can sue the school and the school board, but you will probably not get very far. Go to the school and ask for registration forms and list their address as your address. Do not answer any custody questions. That is not the school's business. If children live in the school district, they should be enrolled. The school is attempting to avoid getting embroiled in a custody battle. If they will not enroll the children, ask for tutoring. if the school will not budge, look for a competent attorney.

You can sue but will probably lose. Custody (and therefore residency) is ordered by the court, not by agreement. You are not empowered to overrule the court, even if everyone wants to. The rules the school board has exist to prevent school shopping -- to make it fair for all. To change the rules, get elected to the school board or support a candidate who feels as you do. You would have one shot at winning. If there is no actual rule being enforced, or it is being enforced incorrectly. Go find out.

ok i have missed 43 days of school this year and we have a court date and all. I failed last year because of 35 absents i live in wake county NC i would really like to know if they would hold me back again i cant get this off my back and im pretty worried please let me know what will happen.

I had the same thing happen to me, when I went to court they offered alternatives. I ended up taking college courses to double my credits and get me back on track as well as attending alternative school and doing home study (the college credits also count toward future college study). I had A LOT more days missed than you. Generally they really want you to be in school and become a successful, productive member of society, if they don't offer you some of these or other alternatives you can suggest them on your behalf. Just be sure to be respectful and put forth that you want to try and amend past behavior and are willing to do whatever necessary to do so. Good luck.

Is it legal to have roosters and chickens in Bergen County, NJ?
my neighbor got two roosters and chickens. i usually don't mind animals ( i used to spend my summers on a farm when i was little) but now it is just simply annoying. the roosters wake me up at 5:45 every morning ( and i go to sleep at 3-4 a.m b/c i have so much school work). i am not planing on reporting them but i still want to know is it legal to have those animals it Bergen County, NJ? *in my town houses are REALLY close to each other which makes it even worse.

lol i like in bergan county too & i know someone who has a TURKEY. the turkey jusy wanders around the person's house like a cat or something. some people are truly amazing. i don't know if it's illegeal but if it bothers you that much you should talk to them about it.

Do you think i can get into UT or Wake Forest University?

Do you think i can get into UT or Wake Forest University?
I have an average GPA of a 3.66, i did not do well on my SAT's at all 1490 (I know for Wake you don't have to submit them), and i plan on majoring in German. Im hoping the fact that i am an African American female planning on majoring in German will have a lot of weight in the decision. I am also very active in my school. That SAT score is a real problem. Is there a good chance you could do better if you re-took the test and crammed for it? The middle half of a recent UT freshman class had scores ranging from 1700 to 2050. Your 1490 is so far below the middle half's low end that it could block your admission. Wake Forest hasn't shared as much information, but 80% of its students do submit an SAT or ACT score, and their middle half scores between 1240 and 1410 on just the math and critical reading (no writing). So I'd say you probably don't have a chance there. I know that's got to be discouraging, but keep in mind that your grades alone can get you into many schools, and that a hard-working student can get a first-rate education at a school whose overall reputation is not one of excellence but of mere competence.

A North Carolina judge has ordered three children to attend public schools this fall because the homeschooling their mother has provided over the last four years needs to be "challenged." The children, however, have tested above their grade levels – by as much as two years. The decision is raising eyebrows among homeschooling families, and one friend of the mother has launched a website to publicize the issue. The ruling was made by Judge Ned Mangum of Wake County, who was handling a divorce proceeding for Thomas and Venessa Mills. A statement released by a publicist working for the mother, whose children now are 10, 11 and 12, said Mangum stripped her of her right to decide what is best for her children's education. The judge, when contacted by WND, explained his goal in ordering the children to register and attend a public school was to make sure they have a "more well-rounded education." "I thought Ms. Mills had done a good job [in homeschooling]," he said. "It was great for them to have that access, and [I had] no problems with homeschooling. I said public schooling would be a good complement." In North Carolina, status quo takes precedence unless there is a compelling reason, such as abuse. These is no allegation of abuse or educational neglect. The judge in this case is ignoring NC law. Why should the lives of these children be uprooted even more than it already is? They have been homeschooling for four years and this should continue until there is a compelling reason for a change. The judge stated that the children should be sent to public school so the ideal of the mother can be challenged. That is not a compelling reason or judges could start pulling children out of private schools because the judge does not agree with the ideology of the school. That should send chills down the spine of every parent, that a judge could step into the family without a compelling reason.

As others have noted, you make no mention of the father's side of the story in this divorce proceeding. If he was pressing for the children to be put into public school, he could be doing so on grounds of the children's social development...of course, I don't know that based on the snippet here, and nor do you.

Second, the article is poorly written in that there is no detail given in how the judge perceived that the parents were doing a disservice/harming their children (that would be public record). the judical system is not an exception to the wrongful actions of people put in office to uphold the constituion of our country. even the supreme court judges are acting according to their political side. Looking at the list of supreme judges they are helping Obama destroy this country. Thoughts & Comments on the Raleigh, NC area?
We are considering a move to the Wake County area - Raleigh, Cary, Apex... I would appretiate any thoughts from those who live or visit there! Schools, shopping, taxes, jobs.... whatever! wow.... that is exactly the kind of input i was looking for. i have heard only from a friend who moved to holly springs from long island - - to them, anything that has taxes less than 10,000 a year is awesome.

please do urself a favor-dont move!!!! it was charming 15 years ago.now,the roads are choked with traffic,the commutes to work are awful.its like driving in manhatten.food prices are high,as hi almost as in nyc-my uncle,visiting recently was surprised.because of massive growth and not enough schools,our kids are being bussed,or forced into year round schedules-with the older and younger kids tracked out at differing times,making family vacations difficult to plan.we have been in the grip of intense drought for months,water is going to be more expensive,and water restrictions are set to become more severe as this drought worsens.taxes have gone up to support more schools,our house values have all gone up-good for sellers,bad for those who now have to pay higher taxes on their properties,with older people on fixed incomes being forced to sell/downsize.teardowns of existing victorian thru 1950's homes is rampant,they are being replaced with ugly mcmansions.we cant stand the L.A style traffic and the fact that every green space is ploughed and paved to make way for yet another mall or apartment complex.everything this city was is being ruined by massive growth.we are moving to my grandmothers rural property,as raleigh is now one big traffic laden mess.cary is the same and apex is getting that way.its called "urban sprawl"-think "stripmall"-and its ugly.i live in the historic partof raleigh downtown-victorian thru 40's homes.sounds pretty,right?ooops,did i mention,its 2 blocks from a section notorious for prostitution and shootings?yes,right down the road are crackhouses.no one seems to be doing much about that.there have been several drug-related killings 2 blocks from my home in "historic oakwood."

NC is where I am from, Charlotte specifically. The tax rate is higher in Charlotte, but the prices of homes in Raleigh are far greater than Charlotte, so in essence, each year you will fork out more in property taxes. I personally, like Charlotte better. People here call it the "big little city" because it's not spread out over a huge geographical area like Raleigh is. Raleigh has also been a huge victim of tons of abandoned buildings in industrial parks that are no longer being used. That makes for a huge eyesore of a city. Raleigh also has more issues with drugs there than Charlotte because I-95 runs right through Raleigh, which is well known by drug enforcement. I can't imagine living anywhere else.

Check NC schools rank on the US list. When we lived there ten years ago NC ranked 48 out of 50. Maybe it's better now. Are you black, because NC is the south and I found many people to be very open about their racial preferences. Keep in mind that I am from the DC metro area where diversity is better accepted. I also found people in general were not very well educated. Quite a surprise for an area so close to Duke University, pharmaceutical companies, RTP, and IBM. North Raleigh and Cary has quite a bit of upper class, but they are very snobby, unless you live in the right area too. I highly suggest you think twice. Good luck, hope you find the right place.

I am shocked to read all of these negative comments. I moved to Raleigh a year ago and although it's not my cup of tea, I dont think I've met a single person here that doesn't love it. The population is growing steadily and most people who move here are from NY or NJ which is why I think they like it, since they can be around the same type of people, if feels familiar. We are in a severe drought, but housing prices will be much cheaper than NY and traffic although locals find horrible will be nothing to you. Also, despite negative comments on schools they are not as awful as described, Wake County Schools, especially those in Cary consistently rank in the top 100 of the nation yearly. And local towns like Cary and Apex also rank in these lists regularly. I suggest visiting and deciding for yourself. Taxes although higher in Cary, still probably won't compare to those in NY from people I've talked to. It can be difficult to find a job but if your in a technological or professional field it shouldn't be a problem with the Research Triangle so close. P.S. to answerer #1 I-95 does not run through Raleigh it's more than 20 miles away and the city is much smaller than Charlotte in geographical size, after all our beltline is only about 20 miles long.

Raleigh is actually a pretty nice city. I don't know where Mary gets her info from...she sounds like she's describing Fayetteville....NOT Raleigh. (Abandoned industrial buildings? WTF????) But I'm not surprised...most people in Charlotte think the rest of the state worships them or something. I've lived in Raleigh for 13 years now, and am a North Carolina native so I think I know my city. It's a decent, fast growing city. The economy is relatively strong here...definitely science-based though, with education and government as other big job sources. Raleigh along with it's neighbor cities Durham and Chapel Hill, forms the Research Triangle area which is a scientific research hub for the region. Lots of colleges here too, as you probably know. Raleigh, Durham and Chapel Hill are growing with more opportunities these days. (That said, if you don't have a job lined up already, I'd probably not move yet.) All three cities here have been doing a good deal of downtown revitalization and urban development in the past decade. I've seen a great deal of change here in the urban cores. As for the other Wake County towns like Cary, Apex, etc, I really don't have much good to say about them. They're just sprawling suburbs full of gated communities, cul-de-sacs, and strip malls. If you've ever seen the movie "Stepford Wives" then you've seen Cary.

I couldn't say, but each branch does have it's own Junior ROTC program, with their own websites. Your best bet would be to go there and see if they are able to answer your questions as far as what programs exist and where they are located. Best of luck to you.

Help Please?

Help Please?
We Lived in Carroll County, MD for 13 years. My daughter attended school there and loved it. We moved because we needed a house where my parents could live with us. So we moved out of the Carroll County school district. My daughter hated her new school, she woke up every morning crying & throwing up, and she wouldn't eat. So my husband and I agreed that our daughter couldnt go through anymore or she would end up in the hospital. Homeschooling is going ok, but not the best. She wants to go back to Carroll County Schools. Thats what I want as well. So we are moving back. Anyway, I was wondering if anyone knows if she will need to take a placement test or what. I mean she successfully completed 8 grade there on the honor roll. She will be entering 11th grade when we move back. She already has her friends there and everything. She still talks and hangs out with those friends. I am just worried if there is a placement test. I mean I know she is very smart and was always on honor roll...

What happens when you child gets reluctant to starting school after a trackout?
This question is in homage to Track 3 tracking back in here in Wake county, NC. Track 2 tracks out. Elementary schools and some middle schools run on a multi-track year round schedule here in Wake County. yet, there will be some kids on Track 3 that will dread tomorrow. What steps will you take if your child doesn't wanna get out of bed or start school for yet another 9 weeks of school? Thank gawd I never had to deal with the multi-track year round schedules.

Hi neighbor! I teach for in Wake County and LOVE the year round schedule. Track out dread has to be easier than back-after-a-whole-summer-off dread. In traditional schools, those kids come back knowing they have a whole 9 months of school ahead of them, with few breaks The year-round kids know that in 9 weeks they will be off again, and that's what I would tell my child if she was dreading it. It is also easier this time of year because Thanksgiving and Christmas break are coming up. Why are you worried about it if you don't have kids in year-round? Are you just trying to start a year-round debate?

There are a lot of approaches you could take, but some of it may be wasted effort. Talk to a counselor or registrar at the school first. 1. They may have a policy to waive certain credits -- so that she will enroll as a junior and graduate as scheduled. You wouldn't have to jump through any hoops. 2. They may require a detailed list of home-schooling classes, so that they may reconstruct the appropriate credits before she may enroll as a junior. If so, create a home-school "transcript" that provides the subject and publisher of the curriculum. You may want to note for each class that either the curriculum was completed, or states the number of hours of study for the year. If curriculum was not completed, you should be aware that most schools would calculate credits based on Carnegie Units -- i.e. 90 hours per 1/2 Unit (which most schools would also call 1/2 credit, unless they use an unusual credit system). They may also ask for significant sample work in these curricula. 3. They might be unfriendly to home-schooling, in which case they may refuse to enroll her at the junior level, and may only accept credits as provided by her other school. This may mean adding a year of school, or taking additional credits through an accredited distance ed school like BYU or UNL. But again, call the counselor first, and ask what options are available before worrying or putting tons of effort into a transcript that may not be used.

I was homeschooled for grades 1-9 in WI. I don't know what the state laws are like in MD, but I did not take any placement test when I went back to public school in 1999. Really, all I needed was a list of credits for the classes I had taken in 9th grade, in order to figure out "transfer" credits. If your daughter is like most homeschoolers, she will have little trouble adjusting back to public school, academically or socially.

So the point here is what to expect in 11th grade? It actually depends on the community/surroundings/people/school i mean if it's a good school she could get a good education but it will be hard at first because she had to adjust. Try talking to the counselor of your daughter to know more information on how things are gonna be on 11th grade. sorry, i couldnt help much because im not familiar with caroll county.

If you and your daughter have a good rapport with the schoolboard and/or principal, they *might* not make her take a placement exam. You should plan as if she will have to, though. I can sympathise with your daughter. I went through something similar in highschool. I hope everything goes well for you and she!

Don't do it!!!!! Don't go back to the gov't institution if you don't "have to". Have you considered finding the BEST possible method of education? She is capable of doing so much more than she will ever accomplish in a group-teaching situation. Studying at home is so rewarding. If studying is not going "the best" at home why will going to groupschool make any improvement? Studying at home and striving for mastery gives any student a chance to really succeed and be prepared for advanced studies in college and/or the workplace. There is more time for followiing independent interests when studying at home. Music, sports, clubs, etc are all available to home-school students.

how to take someone to court for theft?
alright, so long story short; today i was in school and during gym class i changed into my gym clothes for P.E. throughout the time period that i was in gym someway, somehow, someone broke into the locker room and stole twenty dollars out of my wallet and my iPhone, both of these items were in my pockets of my jeans. Literally a couple of minutes ago Officer Anderson called me to his office and found my phone in the trash can. Apparently when these low life, immature, worthless, ruthless children steal cell phones and such and once they realize that the device has a passcode and they have no use for it, they toss it in the trash can. Luckily for me, Officer Anderson was wandering around the school and he decided to look in the trash can of the cafeteria, and amazingly came across my phone. Two of my friends also had their phones, iPods, and cash stolen, but unfortunately for them they still haven't found them. The Officer and school administrators are still looking through and backing up video recordings of when the students entered the locker room and stole the items. Now my question is, if and when they find out who the suspect is, can i and how can i press charges against the suspect? i know that circumstances are different with minors, but i would still very much like to sue them or have them suffer some type of consquence more severe than what the school plans on giving them. I am very desperate for an answer to this question and i am still in the process of doing lots of research on my state laws. This is a crime so the police could identify a suspect, arrest them and charges would be brought against them. Practically, it's unlikely that they will do so for twenty dollars. Yes, I know you feel violated and you want justice. It's more likely the school will identify the thieves and suspend or expel them. You might go to the principle and demand that if they do identify the person guilty of the theft, that person would have to make restitution (or have your parents do so).

Move from NJ to NC warranted?

Move from NJ to NC warranted?
If my next home would be mortgage free? Kids and schooling is a big concern. Please advise. I am thinking about Wake County. I heard school system is best. What about community, people, entertainment etc...... Will this be a good move? I have lots of concerns before the final decision. Anybody who has done this and could share your experience as it would be very helpful. Thanx....

i know at least 8 people who made this exact move (everyone thinks NC is the answer) but after about 3-5 years they all wanted to come back 2 did & the others just wished they never left & could not afford to return on a NC salary

I've lived in both places. Transplanting from NJ to NC is a current, popular move as Charlotte and the surrounding areas are growing and filling with what would be considered affordable, gated communities. For me, community, people and entertainment were all a matter of heading back towards civilization which you can find if you don't mind driving 10 to 20 mins. Malls, movies, outside events, etc. were all great and growing larger to support the influx of the outside world. Should be a good move. There are far worse situations/places to have to move in my opinion. I think you won't be disappointed. Most people that I know are making this move as a reaction to cost/quality of living and job opportunities.

STOP!!! Don't move to NC. Wake county or any other county especially Perquimans and Chowan counties. ( I still own property in NC and I don't think I will ever be able to sell it) This state is awful I moved there 6 years ago and regret it. The people are back woods. yea they seem sweet and friendly at first but then wooffffff out comes the greed.Not to say the school systems is very bad. My son was reading on a 2nd grade level in Kinder-garden in VA when I left to move to NC. The teachers in the system were not teaching him to progress. They didn't promote his advanced knowledge. When we moved he began to excel again and now is doing excellent! I left there and moved to Vero Beach FL. I Love it here! People are normal and they have a great school system!!!! Lots of shopping and things for the kids to do. Florida is great I have been here for two years now and you can get allot of home for a little money right now. I love Vero Beach its the place to be! I
